Four pages long. This document is a written account of the deposition of Henry Walker, who answered questions concerning his relation to both Letitia Carson and Greenberry Smith on October 8th, 1856. On this first page, Henry Walker answers 3 questions. The first is if he is acquainted with Greenberry and Letitia, and for how long. He answers yes, and since 1848. The second question asks if Walker was acquainted with David Carson (deceased) and if so was he acquainted with David in Benton Co O.T. and for how long. Walker answers that he was from 1849 until his death. The third question asks if Walker had a conversation with David a short time previous to his death relative to cattle claimed by Lutishia Carson. Walker answers that he had a conversation with him in August of 1852. The questions continue in the next pages.
On the second page, there are three questions, one continued from the previous page. The first question asks Walker about the conversation he had with David Carson in August 1852. Walker answers that he and David and Letitia were sick, and he came to take care of their cattle. Walker said to David that he had quite a large band of cattle, to which David replied: "that those cattle there were not his except seven head which consisted of two yoke of oxen one cow one yearling &; one sucking calf, and he further said that Twenty seven head of the cattle belonged to Lutishia Carson." The second question prompts more answers from the first, Walker clarifies that Letitia owned 27 head in all, nine cows, and eight calves, the remaining ten head were young cattle of various kinds. The last question on this page asks Walker what David said about where Letitia obtained her cattle, to which he answers that Letitia bought the cow over the plains in 1845 and the offspring were all her property.
On the third page, there are two questions for Henry Walker followed by his signature and the signature of witness James M. Pyle Clerk of the US District Court in and for the county of Douglas. The first question asks Walker if he knows how many other cattle aside from the ones pointed by the said David Carson had he at that time. Walker answers that David pointed out seven head of cattle that he owned. The second question on this page asks Walker if he knows what was done with those cattle at the time of David Carson's death, Walker answers that he does not know. This is the end of the questions, the rest of the page begins the court formality of a signing witness.
On the fourth page, the witness statement and signature continue from the third page. The document ends with a list of fees including Fees of the Clerk totaling $3.00, Fees of the Sheriff totaling $5.30, and witnesses totaling $7.00 the entire sum of fees is $15.30. It is signed by witness James M. Pyle Clerk of the US District Court in and for the county of Douglas.
