February 22, 1842, David Carson vs William H, Spratt & others Anderson Martin garnishee

This document is from a series of Missouri court cases concerning David Carson during his time in Platte County, Missouri. It reads. "David Carson vs William H, Spratt & others In the state circuit court March term 1842 Anderson Martin garnishee The answer of Anderson Martin who was summoned as garnishee in the above cause. The said Anderson Martin answering saith that William H. Spratt, on of the above defendants, conveyed to him sometime in June 1841 a certain house and lot in the town of Platte City in trust to secure the payment of four hundred and twenty six 50/100 dollars to one Elisha Green, that she sold said house and a lot aforesaid as trustee on the 7th day of ?? Instant for the sum of six hundred and thirteen dollars that the sum of four hundred and $426.50 dollars was paid to said Green agreeably to provision of said deed of trust, that he now has in his hands the sum of one hundred and seventy one 50/100 dollars which is the balance owing from the sale of said house and lot after deducting the sum of fifteen dollars for expenses incident to the sale of said property, that he has been summoned as garnishee in two other instances since the said deed of trust was executed to him, that he is ready to pay the sum of $171.50 the balance remaining in his hands to whomever the court shall direct. He further states that owes said defendant nothing nor has he in his possession or under his control any goods monies or affects belonging to said defendant or either of them except as above stated." It is then signed by Anderson Martin, Jesse Norris, clerk, and Ira Norris D., clerk.
