“James H. Bullard and Brothers vs David Carson
Debt - $17.90
Jus Fees - 2.00
Cons. Fees - 1.25
Witness Fees - 1.00
Suit brought on account of $17.90 for money paid on freight at sundry times, and for storage on goods (or groceries) at sundry times as per bill of particulars filed.
August the 10th 1839 on application of the plaintiff, a summons issued, returnable on the 14th of September at 10 o'clock in the forenoon, which was returned by Joseph Todd Const., two subpoenas which had been issued, one by the request of the plaintiff, for David Carson, the defendant; and the other by the request of the defendant, for David English, James H. Johnston & Joseph Atkins, executed in the same manner by Joseph Todd Const.
September 14th, 1839 the parties attended, and the plaintiff called upon the defendant to testify, in relation to the matter in controversy (no jury being required) the defendant was sworn and examined, relative to the account from whose testimony, it appeared, that the chargers was all denied, in consequence of which, judgement was rendered against the plaintiff for the costs of suit, Appeal Allowed on the 21st Sept 1839.” It is signed by Charles Wells Justice of the Peace.
