Affidavit to obtain an Appeal
Before me, Charles Wells, one of the Justices of the Peace for Lee Township in Platte County Personally came Nicholas E Broaddus who being duly sworn according to law, doth depose and say that whereas Judgement was rendered against him for the costs in the above cause, on the 14th day of Sept. 1839. And that he demands an appeal from the Judgement of the Justice, in the above cause, and that this appeal is not demanded in order to delay the prosecution of the above suit, from a speedy and final decision; nor for any aggravating purpose, only that he considered himself aggrieved by the decision of the Justice, and that he demands an appeal to the circuit court only on that account and further this appellant saith not.” It is signed by N E Broaddus and Charles Wells, Justice of the Peace.
