Description

This is the original Polk County recording of David Carson's Soap Creek Valley land claim in 1847. The first half of the page seems to cover a separate land claim for another person, but the bottom half covers David Carson’s 640-acre land claim in Polk County. It reads, “David Carson claims 640 acres of land in Polk County, situated on a Creek known by the name of Soap Creek and founded as follows. Commencing at a stake on the S side of the creek, marked with 3 notches then a -inning N one mile to an Oak State on the S side of a — with 3 notches then a E one mile to an ash stake in the prairie marked with 3 notches then a S one mile to an Oak stake marked as before then a N one mile to the place of — said claim was taken in proved by the claimant in December 1845 which he — by personal occupancy Recorded October 19th, 1847 Attest Theo Magruder Recorder.” It is interesting that this was signed by Theo Magruder because Magruder was the man who in 1851 reported Jacob Vanderpool for violating the 1849 Black exclusion law in Oregon City. Jacob Vanderpool was an African American owner of a saloon, restaurant, and boarding house living in Oregon City, Clackamas County, Oregon at a time when the Oregon Territory government enforced an exclusion law it had passed in 1844 that prevented blacks from living in the territory. In 1851, Vanderpool's neighbor, Magruder brought suit against him, and Judge Thomas Nelson expelled him from the territory.
