Description

This document is written by Benjamin L. Young as he appoints power to his attorney Mathew Carson and claims a connection to David Carson's Missouri estate. It comes from a series of North Carolina and Missouri documents in which relatives of David Carson claimed ownership of his Missouri estate as it was being settled in the wake of his death. He writes, "Know all men by these presents that I Benjamin Young of the county of Carroll in the State of Virginia has this day made constituted and appointed and by these presents do make constitute & appoint Mathew Carson of the County of Ash in the State of North Carolina my legal attorney in fact to demand collect sue for and receive & receipt for in my name & for me to collect & receive all dues money & effect property personal & real and all dues that may be coming to me from the estate of David Carson deceased late of Platte County in the State of Missouri and the money debt & property & effects is now in the hand of John Robertson [sic] in the last aforesaid county & State or due to him as Such administrator the Said money & effect I am entitled to as husband of Jane Young formerly Jane Carson daughter of James Carson deceased & legal heir of David Carson deceased hereby notifying & confirming all & everything that my Said Attorney Mathew Carson may Shall or may legally doe in and above the promises as fully & as effectually as if I myself were personally present & assenting thereto. In testimony whereof, I have hereunto set my hand & affixed by Seal this the 2nd day of March 1857." He uses his marriage to Jane Carson as justification for his claim to Carson's land. The document continues on and is signed and confirmed by Esau Winett Clerk of the County Court of Carroll County on March 2nd, 1857. Lastly, it is signed by W.C. Remington, Recorder for Circuit Court of Platte County Missouri.
