Description
This document is from a series of Missouri court cases concerning David Carson during his time in Platte County, Missouri. It reads, “This affiant makes oath and states that he cannot safely [sic] go into the trial of the above cause on the account of the absence of Alexander Hinkley, who is a material witness on his behalf, the said cause he knows of no other person by whom he can ? The same facts which he purposes to prove by said Hinkley. Said Hinkley lives in Independence Jackson County Missouri within the distance of sixty miles from this place. The said Hinkley is absent without the consent or convenience of this official. This affiant states that he had a subpoena for Hinkley to give testimony, at the present session of this court in this cause and expected his attendance accordingly. He thinks and believes on that he will be able to procure the attendance of said Hinkley at the next session of this court and will make use of all legal means to secure the same. This affiant states that he applies for a continuance not for the purpose of vexation or delay, but because he believes he has merits and for the purpose of justice alone.” It is signed by Wm N. Spratt and L Morin C.
